The portions of this layer in Florida were developed by the Florida Fish and Wildlife Research Institute (FWRI) for the U.S. Coast Guard. The other portions of this layer were developed by the EPA and merged together with the FWRI's Florida portion.

MEMORANDUM OF AGREEMENT BETWEEN U.S. ENVIRONMENTAL PROTECTION AGENCY – REGION 4 AND U.S. COAST GUARD – FIFTH, SEVENTH, AND EIGHTH DISTRICTS Purpose. The intent of this memorandum is to delineate the Region 4 Inland and Coastal Zone geographical boundaries establishing responsibility for the pre-designation of On-Scene Coordinators (OSCs) for pollution response pursuant to the National Oil and Hazardous Substances Contingency Plan (NCP). Definitions. The following definitions will apply to this Memorandum of Understanding. Vessel. Every description of watercraft or other artificial contrivance used, or capable of being used as a means of transportation on water. This definition excludes permanently moored structures which, while they may appear to be vessels are not inspected by the Coast Guard, i.e. barges moored at facilities effectively used as part of a non-transportation-related facility complex. Commercial Vessel. As defined in this MOU, commercial vessel means tank vessels (ships and barges); freight ships and barges; commercial fishing vessels; inspected passenger vessels; and uninspected towing vessels. This definition excludes recreational vessels and uninspected passenger vessels carrying six or fewer persons for hire. Marine Transportation-Related Facility (MTR Facility). Any onshore facility or segment of a complex regulated under section 311(j) of the Federal Water Pollution Control Act by two or more Federal agencies, including piping and any structure used or intended to be used to transfer oil to or from a vessel. The marine transportation-related portion of the complex extends from the facility oil transfer system’s connection with the vessel to the first valve inside the secondary containment surrounding tanks in the non-transportation-related portion of the facility or, in the absence of secondary containment, to the valve or manifold adjacent to the tanks comprising the non-transportation-related portion of the facility, unless another location has been agreed to by the U.S. Coast Guard Captain of the Port (COTP) and the appropriate Federal official.
Inland Zone Boundary Designation. The U.S. Environmental Protection Agency (EPA), Region 4 provides the pre-designated On-Scene Coordinator (OSC) for pollution response in the Inland Zone. All discharges or releases, or a substantial threat of such a discharge or release of an oil or hazardous substances originating within the Inland Zone will be the responsibility of the EPA. Included are discharges and releases from unknown sources or those classified as “mystery spills”. The EPA OSC will be the pre-designated OSC for all areas or pollution incidents within Region 4 that are not specifically addressed by the following coastal zone boundary designation descriptions or the general response provisions delineated within this document. Coastal Zone Boundary Designations. The cognizant U.S. Coast Guard Captain of the Port (COTP) is the pre-designated On-Scene Coordinator (OSC) for pollution response in the Coastal Zone. All discharges or releases, or a substantial threat of such a discharge or release of an oil or hazardous substances originating within the Coastal Zone will be the responsibility of the U.S. Coast Guard OSC. Included are discharges and releases from unknown sources or those classified as mystery spills”. For clarity within this section, the term “waterfront facility” will be defined in accordance with the definitions found in 33 CFR 125-127, 148 and 154. The following are the Coastal Zone descriptions for each respective U.S. Coast Guard OSC that is located within federal Region 4: Fifth Coast Guard District Hampton Roads, Virginia Captain of the Port (COTP), Hampton Roads, Virginia, will be the pre-designated OSC in the following areas within Federal Region 4. When a roadway is used to delineate a boundary, that boundary shall be to, but shall not include, the roadway. The northern boundary extends from the offshore extent of the Exclusive Economic Zone at 36-33.0N, 071-28.0W shoreward along 36-33.0N latitude to the VA/NC border; then west along the border to the west bank of the Dismal Swamp canal; then south along the west bank of the Dismal Swamp Canal to U.S. Route 17; then along U.S. Route 17 across the bridge at Edenton, NC to the west bank of the Albemarle Sound; then south along the west bank of Albemarle Sound to State Hwy. 45; south along State Hwy. 45 to U.S. Route 64 near Plymouth,NC; then east along U.S. Route 64 to State Hwy. 94 at Columbia, NC; then south along State Hwy. 94 across U.S. Route 264 to a point in Pamlico Sound at 35-37.0N, 076-14.0W; then east to a point 35-37.0N, 076-00.5W;then easterly to a point on the shore of Portsmouth Island along 34-59.8N; then due east along 34-59.8N to the offshore extent of the Exclusive Economic Zone at 34-59.8N, 071-28.0W. All spills originating from waterfront facilities within the city limits of Elizabeth City, NC, Hertford, NC,Edenton, NC, and Washington, NC will have the Marine Safety Office as the pre-designated OSC. Wilmington, North Carolina Captain of the Port (COTP), Wilmington, North Carolina, will be the pre-designated OSC in the following areas within Federal Region 4. When a roadway is used to delineate a boundary, that boundary shall be to, but shall not include, the roadway. Coastal areas from the sea at 34-59.8N, 76-07.8W northwesterly to a point 35-01.5W, 76-10W; hence westerly to a point 35-01.5N, 76-20W; hence northeasterly to a point 35-37N, 76-00.5; hence westerly to a point 35-37N, 76-14W; hence south along State Highway 94 to its intersection with the ICW; hence west along the north bank of the ICW to its intersection with US Route 264; hence west along US Route 264 to US Route 17 at Washington; hence south along US Route 17 to State Highway 33 at Chocowinity; hence south along State Highway 33 to State Highway 304; hence south along State Highway 304 to State Highway 55 at Bayboro; hence west along State Highway 55 to US Route 17 at Bridgeton; hence south along US Route 17 to US Route 70 at James City; hence south along US Route 70 to State Highway 24; hence west along State Highway 24 to US Route 17 at Jacksonville; hence south along US Route 17 to State Highway 132; hence south along State Highway 132 to US Route 421; hence north along US Route 421 to Shipyard Boulevard; hence east along Shipyard Boulevard to 17th Street; hence north along 17th Street to Market Street; hence east along Market Street to 23rd Street; hence north along 23rd Street to State Highway 133; hence north along State Highway 133 to the Pender-New Hanover County line; hence west along the Pender-New Hanover County Line to the west bank of the main branch Cape Fear River (all waterfront facilities along the boundary on the north side of the Northeast Cape Fear River are included in the coastal region); hence south along the west bank Cape Fear River to the west bank of the Brunswick River; hence south along the west bank Brunswick River to US Route 17; hence south along US Route 17 to the NC-SC Border. All spills originating from the Marine Transportation Related portion of a facility within the city limits of New Bern, NC, Jacksonville, NC, and Wilmington, NC will have the Marine Safety Office as the pre-designated OSC.
Seventh Coast Guard District Charleston, South Carolina U.S. Coast Guard Captain of the Port (COTP), Charleston, South Carolina will be the pre-designated OSC in the following areas within Region 4. When a roadway is used to delineate a boundary, that boundary shall be to, but shall not include, the roadway. Coastal areas on the eastern coast of South Carolina from the North Carolina – South Carolina state boundary southward to the southern tip of Bay Point, Edisto Island (near Edisto Beach), South Carolina. From the North Carolina – South Carolina state boundary northwesterly along the boundary to US 17; thence southwesterly along US 17 to the eastern bank of the Edisto River; thence southerly along the eastern bank to the COTP Charleston – COTP Savannah boundary at 32-41 N Latitude. Included within this zone are Charleston Harbor areas, including waterfront facilities, specifically, Ashley River from the Memorial Bridge (SC 7) seaward; Wando River from State Highway 41 (SC 41) Bridge seaward; and the Cooper River from General Dynamics Private Aids 339 and 340 seaward. Also included are all portions of the Intracoastal Waterway not within the above defined area, and the Sampit River/Winyah Bay (near Georgetown) area, including waterfront facilities, from one mile west of US 17 Sampit River Bridge seaward. Savannah, Georgia U.S. Coast Guard Captain of the Port (COTP), Savannah, Georgia will be the pre-designated OSC in the following areas within Region 4. When a roadway is used to delineate a boundary, that boundary shall be to, but shall not include, the roadway.Coastal areas from the southern tip of Bay Point, Edisto Island (near Edisto Beach), South Carolina, south to 30- 50 N latitude on the east coast of Georgia. From the southern tip of Bay Point, Edisto Island, South Carolina, northerly along the eastern bank of the Edisto River to U.S. Highway 17; thence southwesterly to I-95 (SC Exit #33); thence southerly along I-95 to GA Highway 21 (GA Exit #19); thence southerly along GA Highway 21 to I-516; thence southerly along I-516 to GA Highway 21 (DeRenne Ave); thence easterly to GA Highway 204 (Abercorn Street); thence southwesterly to bI-95 (GA Exit #16); thence southerly along I-95 to the intersection of COTP Savannah – COTP Jacksonville boundary at 30-50 N latitude on the east coast of Georgia.
Jacksonville, Florida U.S. Coast Guard Captain of the Port (COTP), Jacksonville, Florida will be the pre-designated OSC in the following areas within Region 4. When a roadway is used to delineate a boundary, that boundary shall be to, but shall not include, the roadway. Coastal areas from 30-50 N latitude on the east coast of Georgia southward to 28 N latitude on the east coast of Florida. Latitude 30-50 N on the east coast of Georgia due west to I-95; thence southerly to US 17 Interchange, Becker, Florida; thence southerly along US 17 to Trout River Drive, Jacksonville (Panama Park), Florida; thence southwesterly to State Highway 115 (FL 115); thence easterly along FL 115 to Buffalo Avenue; thence southerly over the John Matthews Toll Bridge to University Blvd.; Thence northerly to Ft. Caroline Road; thence easterly to FL 101A; thence southerly to the intersection with the St. Johns County line; thence south and west along the St. Johns County line to US 1; thence southerly to I-95, Marineland interchange; thence southerly to US 1, Ormand By The Sea interchange; thence southerly to the intersection of COTP Jacksonville-COTP Miami boundary at 28 N latitude (near Malibar). Also included is the St. Johns River south to Lake George.
Miami, Florida U.S. Coast Guard Captain of the Port (COTP), Miami, Florida will be the pre-designated OSC in the following areas within Region 4. When a roadway is used to delineate a boundary, that boundary shall be to, but shall not include, the roadway. Coastal areas from latitude 28 N on the east coast of Florida southward to the southern tip of Cape Romano onthe west coast of Florida, and the Florida Keys to and including Dry Tortugas. Latitude 28 N on the east coast of Florida, near Malabar, due west to US 1; thence generally southward to South Bayshore Drive, Miami including the St. Lucie River North Fork to Greenridge Point and the St. Lucie River South Fork to the St. Lucie Canal entrance, the Loxahatchee River to the Martin and Palm Beach County lines, the Miami River to the N.W. 36th Street Bridge, Miami; thence generally southwestward along South Bayshore Drive, Miami to Old Cutler Road via McFarlane Road, Main Highway, and Ingraham Highway; thence generally southwestward along Old Cutler Road to Florida’s Turnpike; thence generally southward to S.W. 107th Avenue, Miami (south Allapattah); thence generally southward along and beyond S.W. 107th Avenue to 25-20N latitude, 80-22W longitude; thence generally westward to 25-13N latitude, 80-48W longitude; thence generally northwestward to the intersection of U.S. Highway 41 and Florida State Road 839, thence generally westward along U. S. Highway 41 to its intersection with the COTP Miami-COTP Tampa boundary at 81-33W longitude. Also included will be responses to discharges and releases from commercial vessels in the Intracoastal Waterway (St. Lucie Canal, Lake Okeechobee, and Okeechobee Waterway) from Stuart, Florida to 081-30 W longitude(near FL Highway 29 Bridge, La Belle, Florida) and waterfront facilities along the St. Lucie River, the Loxahatchee River and the Miami River to points described above.
Tampa, Florida U.S. Coast Guard Captain of the Port (COTP), Tampa, Florida will be the pre-designated OSC in the followingareas within Region 4. When a roadway is used to delineate a boundary, that boundary shall be to, but shall not include, the roadway. Coastal areas from the southern tip of Cape Romano, Florida, northerly to the intersection of the west coast of Florida with longitude 083-50 W (mouth of the Fenholloway River). From the intersection of the west coast of Florida with longitude 083-50 W (mouth of the enholloway River) due north to US 98 (intersection of COTP Tampa-COTP Mobile boundary); thence easterly to US 19 and Alternate 27; thence southerly to FL 361; thence southerly to FL 358; thence westerly to US 19 and Alternate 27; thence southerly to US 19 and 98; thence southerly along US 19 to Alternate US 19; thence southerly to FL 697; thence southerly to FL 595; thence northerly to FL 688; thence easterly to FL 695; thence southerly to FL 690; thence easterly to 22nd Avenue south, St. Petersburg; thence easterly to 4th Street South, St. Petersburg; thence northerly to FL 687; thence northerly to FL 686; thence westerly to US 19; thence northerly to FL 590; thence easterly to FL 580; thence easterly to FL 576; thence easterly to FL 589; thence southerly to I-275; thence northerly to FL 587; thence southerly to FL 685; thence northerly to the Crosstown Expressway, Tampa; thence northeasterly to US 41; thence southerly to US 301; thence northerly to FL 675; thence southerly to FL 64; thence westerly to US 41; thence southerly to FL 78; thence easterly to FL 31; thence southerly to FL 80; thence westerly to US 41; thence southerly to FL 78; thence easterly to FL 31; thence southerly to FL 80; thence westerly to US 41; thence southerly along US 41 to the intersection of COTP Tampa-COTP Miami boundary at 081-33 W longitude. Also included will be response to discharges and releases from commercial tugs and/or barges in the Intracoastal Waterway (Okeechobee Waterway) from 081-30 W longitude (near Fl State Highway 29 Bridge, La Belle, Florida) westerly to the Gulf of Mexico.
Eighth Coast Guard District Mobile, Alabama U.S. Coast Guard Captain of the Port (COTP), Mobile, Alabama will be the pre-designated OSC in the following areas within Region 4. When a roadway is used to delineate a boundary, that boundary shall be to, but shall not include, the roadway.The Coastal Zone boundary begins at the intersection of the southern limit of the Right-of-Way on US Highway 98 (US-98) with the Captain of the Port (COTP) Mobile – COTP Tampa boundary (083-50 West Longitude). The intersection is twelve (12) miles west of Hampton Springs, FL on US-98. Then, westerly on US-98 to St. Marks, FL, then southwesterly along US-98 to the junction of the John Gorrie Memorial Bridge and the north shore of the Gulf Intracoastal Waterway (GICW) at Apalachicola, FL,, -including Ochlockonee Bay, East Bay, navigable portions of East and West Bayou, Blounts Bay, Shoal Bayou, and Alligator Bayou. Then, continuing from the junction of the southern limit of the Right-of-Way at the John Gorrie Memorial Bridge and the north shore of the GICW to its intersection with Alabama State Highway 59 (AL-59). Responsibilities also include: East Bay, St. Andrews Bay, West Bay, Choctawhatchee Bay, Santa Rosa Sound. East Bay (Blackwater Bay), Escambia Bay, Pensacola Bay, Perdido Bay, and Wolf Bay. Then, north on AL-59 to its intersection with Interstate Highway 65 (I-65). Then, west and southwesterly along I-65 to its intersection with US Highway 90 (US-90) near Theodore, AL. Then, westerly along US-90 to 89-10 W longitude (near Long Beach, MS); thence south to the Mississippi coast, the boundary with COTP New Orleans. Additionally all discharges or releases originating from waterfront facilities within the city limits of Panama City, Fort Walton Beach, and Pensacola, Florida; Mobile, Alabama; and Pascagoula, Biloxi, and Gulfport, Mississippi are the responsibility of the U.S. Coast Guard Captain of the Port Mobile as the pre-designated OSC.
Huntington, WV / Louisville, KY / Paducah, KY / Memphis, TN These Eighth Coast Guard District Captain of the Port (COTP) offices are exclusively located within the Inland Zone. Portions of their COTP Zones are located within Region 4. To align agency pollution response responsibilities along functional lines that are consistent with traditional agency authorities, these COTPs shall respond to pollution incidents as the federal OSC in accordance with the criteria indicted in the “General Response Provisions” section below. Although this section is also applicable to the cognizant coastal zone U.S. Coast Guard OSCs, it serves as the primary doctrine for Inland U.S. Coast Guard pollution response actions. These provisions allow for the effective integration of preparedness and removal activities in a manner consistent with the requirements of the National Contingency Plan (NCP). General Response Provisions. These provisions apply to all U.S. Environmental Protection Agency OSCs and U.S. Coast Guard COTP/OSCs serving Federal Region 4. During pollution responses to natural disasters or to other incidents when the Federal Response Plan (FRP) is activated, pollution impacts may affect many areas within the region. In these instances, OSC boundary designations may not be strictly adhered to in an effort to best use available resources to respond to the myriad of pollution issues under the guide of the FRP and Emergency Support Function (ESF) #10. However, under ESF #10, care shall be taken to place an OSC on an incident consistent with the parent agency’s expertise. The U.S. Coast Guard (USCG), through the cognizant Captain of the Port (COTP), will assist the inland zone pre-designated EPA On-Scene Coordinator (OSC) consistent with agency responsibilities and authorities. The Coast Guard Captain of the Port will assume the role of OSC in response to an incident in the Inland Zone when it involves a commercial vessel, a commercial vessel transfer operation, the marine transportation-related portion of a facility, and results in an actual discharge or threatened discharge of oil or hazardous substance into or on the navigable waters of the United States, its shoreline or the riverbank. The EPA shall be advised of any response actions via normal POLREP’s and when the reported discharge or release is an actual or potential major discharge or release, the COTP shall immediately notify EPA through the RRT as per NCP Section 300.320(a)(2)(i). The proposed boundary lines do not preclude mutual assistance between the two agencies.In this Federal region, the U.S. Environmental Protection Agency (EPA) and the U.S. Coast Guard (USCG) will carry out agency and specific pollution response responsibilities under the National Contingency Plan (NCP), the Regional Contingency Plan (RCP), and the applicable Area Contingency Plan (ACP), and will assist each other to the fullest extent possible to prevent or minimize the impacts of an actual discharge or release, or a substantial threat of such a discharge or release, of an oil or hazardous substance into or on the waters of the United States or adjacent shorelines where each respective agency has jurisdiction.
Amendments and Effective Date. This agreement will be subject to review and amendment coincident with each periodic review of the Regional,Area, and other applicable contingency plans and any other time at the request of any of the parties. It will remain in effect until modified or terminated by mutual agreement. Points of contact for the coordination, support, and implementation of this agreement are as follows: EPA Region 4 – Chief, Emergency Response and Removal Branch, Atlanta, GA at (404) 562-8721; Fifth Coast Guard District – Chief, Marine Safety Division, Portsmouth, VA at (757) 398-6637; Seventh Coast Guard District – Chief, Marine Safety Division, Miami, FL at (305) 536-5651; and Eighth Coast Guard District – Chief, Marine Safety Division, New Orleans, LA at (504) 589-6271. Regional and Area Contingency Plans of the signatory agencies will be amended to reflect the following geographical boundaries. This MOU supercedes other MOUs previously enacted concerning the federal predesignated OSC boundaries for purposes of pollution response within federal Region 4.
