These data identify, in general, the areas of Final critical habitat (terrestrial) for the Northwest Atlantic Ocean Distinct Population Segment of Caretta caretta (Loggerhead sea turtle). Please see the federal register for textual descriptions of each unit. In general, critical habitat units include lands from the mean high water line landward to the toe of the secondary dune or developed structure. Each unit contains all of the primary constituent elements as defined below. Due to the dynamic nature of the shoreline, the gis representation of the proposed critical habitat may not appear to match the shoreline in all areas when compared to aerial imagery produced in a different time period, of a different resolution, or viewed at a different scale than the imagery with which it was created. The terrestrial primary constituent elements specific to the Northwest Atlantic Ocean DPS of the loggerhead sea turtle are: (1) Primary Constituent Element 1—Suitable nesting beach habitat that has (a) relatively unimpeded nearshore access from the ocean to the beach for nesting females and from the beach to the ocean for both post-nesting females and hatchlings and (b) is located above mean high water to avoid being inundated frequently by high tides. (2) Primary Constituent Element 2—Sand that (a) allows for suitable nest construction, (b) is suitable for facilitating gas diffusion conducive to embryo development, and (c) is able to develop and maintain temperatures and a moisture content conducive to embryo development. (3) Primary Constituent Element 3—Suitable nesting beach habitat with sufficient darkness to ensure nesting turtles are not deterred from emerging onto the beach and hatchlings and postnesting females orient to the sea.
- Purpose:
-
Critical habitat constitutes areas considered essential for the conservation of a listed species. These areas provide notice to the public and land managers of the importance of the areas to the conservation of this species. Special protections and/or restrictions are possible in areas where Federal funding, permits, licenses, authorizations, or actions occur or are required.
- Supplemental_Information:
-
Due to the dynamic nature of the shoreline critical habitat boundaries may not appear to align with some features when overlain on aerial imagery other than that with which it was established due to differences in resolution and date of acquisition. The textual unit descriptions in the final rule are the legal source for the critical habitat units.

The GIS files and their associated coordinates are not the legal source for determining the critical habitat boundaries of species described in this dataset, but are used to identify areas which contain the physical and biological features essential to the conservation of the species or areas otherwise determined to be essential. Inherent in any dataset used to develop graphical representations, are limitations of accuracy as determined, among others, the source, scale and resolution of the data. While the U.S. Fish and Wildlife Service makes every effort to represent the critical habitat shown with data as completely and accurately as possible (given existing time and resource constraints), the USFWS gives no warranty, expressed or implied, as to the accuracy, reliability, or completeness of these data. In addition, the USFWS shall not be held liable for improper or incorrect use of the data described and/or contained herein. Graphical representations provided by the use of these data do not represent a legal description of the critical habitat boundary. The user is referred to the critical habitat textual description in the appropriate final rule for this species as published in the Federal Register. These data are to be used only in the context of the definition and purpose of critical habitat. This primarily relates to Section 7 consultation under the Endangered Species Act. These data may be used for planning and land management purposes. They are not to be used for legal survey use. Please refer to Federal Register Citation Number 79FR132, published 07-10-2014 for the legal critical habitat information.

The occupied areas that contained the physical and biological features essential to the conservation of the species were delineated using Google Earth Imagery in June 2012. Due to the dynamic nature of the shoreline, the gis representation of the final critical habitat may not appear to match the shoreline in all areas when compared to aerial imagery produced in a different time period, of a different resolution, or viewed at a different scale.

In September 2012 the Google Earth file was imported into ArcGIS and edited to conform to the shoreline using Bing Imagery at a scale of 1:10,000. Due to the dynamic nature of the shoreline, the gis representation of the final critical habitat may not appear to match the shoreline in all areas when compared to aerial imagery produced in a different time period, of a different resolution, or viewed at a different scale.
